Every Garden Is Upstream: How a Rewilded Back Garden Reaches the River Ouse

In the summer of 2026, Newhaven Town Council did something quietly radical. Meeting at the very mouth of the River Ouse, the place where thirty-odd miles of Sussex water finally reaches the sea, councillors voted unanimously to endorse the River Rights Charter, formally recognising the Ouse as a living entity with the right to flow, to be free from pollution, to support native life, and to be actively restored. The motion passed without a single vote against. The Mayor put it plainly: the health of the river matters, and the town intends to weigh it in everything it does.


Newhaven is the latest link in a remarkable chain. In February 2025, Lewes District Council became the first authority in England to recognise a river's rights, championing a Charter co-created by the community group Love Our Ouse with the Environmental Law Foundation, Sussex Wildlife Trust, the Ouse and Adur Rivers Trust and the Railway Land Wildlife Trust. One by one, the councils along the water followed; Wealden, Lewes Town, then the parishes of Hamsey, Piddinghoe, Barcombe, Rodmell and Ringmer. Newhaven, sitting downstream of all of them, catches the consequences of every decision made further up the valley.


And here is the part that should make every suburban gardener sit up: the Charter was never only about the river's main channel. It was written to protect the river, its whole catchment, and the bioregion it belongs to. That means the river's "rights" extend across the entire area of land that drains into it, including, quite literally, your back garden.


Your garden is in the river's body

We tend to picture a river as the blue line on a map. Hydrologically, a river is the land as much as the water. Every drop that falls on a rooftop, a lawn, a patio or a flowerbed within the catchment either soaks into the ground or runs off toward a drain, a ditch, a tributary — and eventually the Ouse itself. The Sussex Ouse and its feeder streams rise in the chalk aquifers of the South Downs, so what happens on the surface of the land is directly bound up with what happens in the water.


This matters at a scale most people underestimate. Recent mapping by the Royal Horticultural Society and the AI firm Gentian found that domestic gardens in the UK cover around 960,000 hectares, roughly 4.6% of the country's entire land area, and about three times the combined size of all its national nature reserves. Individually, one garden is a rounding error. Collectively, gardens are a catchment-scale piece of green infrastructure. What we choose to do with them is a water-quality decision whether we realise it or not.


Rewilding a back garden affects the river in two ways: directly, by changing what leaves your soil and how fast, and indirectly, by changing the deeper hydrology and ecology of the whole valley.


The direct effects: what leaves your soil, and how fast

Slowing and soaking the rain. A conventional garden with its clipped lawn, compacted soil, paving, a shed roof draining straight to the road behaves a lot like a hard surface. Rain sheets off it. A rewilded garden does the opposite. Deep-rooted native plants, undisturbed soil rich in organic matter, and layered vegetation all intercept rainfall and let it infiltrate where it lands rather than rushing to the nearest gully. The trend runs the wrong way at present: around one in four UK front gardens is now fully paved, roughly triple the proportion of two decades ago, and nearly a third have no plants at all. The RHS estimates that simply restoring plant cover to a million front gardens could hold back millions of litres of stormwater runoff every year.


Easing the pressure on overloaded sewers. This is the most direct link to river pollution. Many urban and town drainage networks are combined sewers, carrying both rainwater and sewage in the same pipes. When heavy rain overwhelms them, the excess is released, untreated, through storm overflows, and much of it ends up in rivers. Every square metre of garden that absorbs its own rainfall instead of shunting it into the drain is a square metre of pressure lifted off that system. Slower runoff means fewer overflow events, which means less sewage reaching the Ouse. A rain garden or a soakaway in a single back garden is a small thing; ten thousand of them across a catchment are a flood-and-pollution intervention.


Keeping chemicals out of the water. The conventional garden's fertilisers, weedkillers and pesticides don't stay put. They wash off with the next downpour and travel, via drains and ditches, into watercourses where nitrogen and phosphorus drive the algal blooms that starve rivers of oxygen, and where pesticides harm the insects at the base of the aquatic food web. A rewilded garden, by definition, stops feeding chemicals into that flow. Composting, mulching and letting natural cycles do the fertilising means the water leaving your soil is cleaner than the water leaving your neighbour's.


The indirect effects: recharge, resilience and corridors

Recharging the aquifer that keeps the river alive. Because the Ouse's tributaries are fed by the chalk of the South Downs, the river's health in dry spells depends on groundwater slowly released from that aquifer. Water that infiltrates through living soil helps recharge groundwater; water that runs off a paved surface is lost to the drain and, ultimately, straight to the sea. In a warming climate with longer droughts, a landscape full of absorbent, rewilded gardens is a landscape that holds more water in reserve sustaining the baseflow that keeps chalk streams cool, clear and running when they would otherwise falter.


Buffering the floods that damage the river itself. Flooding isn't only a problem for houses. Flash floods scour riverbeds, dislodge gravels that fish spawn in, and dump sediment and pollutants downstream. Gardens that behave like sponges rather than gutters flatten those peaks, protecting the river's physical structure as well as our own front rooms.


Extending habitat to the water's edge. The Charter exists to protect a genuinely rich ecosystem; the Ouse is home to otters, bitterns, the largest sea trout in the country, gathering shoals of grey mullet, and Daubenton's bats that skim the water's surface to feed. None of that life respects a garden fence. A network of rewilded gardens forms stepping-stones and corridors that let species move through the built-up parts of the valley and reach the riverside habitat that sustains them. The bats foraging over the Ouse depend on the insects your unmown, unsprayed, pond-holding garden helps produce.


The Charter, translated into a flowerbed


The four rights Newhaven endorsed read almost like a rewilding brief for the domestic garden:


  • The right to flow naturally. Depave. Swap impermeable surfaces for gravel, planting or permeable paving, and let rainfall soak in rather than surge into the drain. (Worth knowing: since 2008, laying more than five square metres of impermeable surface that drains to the road at the front of a house needs planning permission; the rules already point this way.)

  • The right to be free from pollution. Garden without synthetic fertilisers, pesticides or herbicides, so nothing toxic leaves your soil for the river.

  • The right to support native biodiversity. Plant native, layer your planting, dig a pond, leave the leaf litter and the long grass and become one 'node' in a corridor reaching to the water.

  • The right to be actively restored and regenerated. Build soil. Organic matter, mulch and undisturbed ground turn your garden into a store of water and carbon and a living filter for everything that passes through it.


The Charter carries no new legal obligations. Its power is a change of relationship; a decision to treat the river as a living body rather than a drain. That shift is exactly what a rewilded garden embodies. You are not tidying a private plot; you are tending a small, working part of a river basin.


Upstream of someone

Newhaven's councillors made their pledge standing at the end of the story, where every choice made across the catchment finally arrives. Most of us garden somewhere in the middle of it. And that is the quiet truth the Ouse's new rights make impossible to ignore: wherever you are in the valley, your garden is upstream of someone; a neighbour, a wetland, a spawning ground, a town at the mouth of the river.


We spent a long time treating rivers as something separate from ourselves, somewhere the water goes to be forgotten. The Ouse's recognition is a chance to remember that the river fills from all of us, and, more literally than we tend to think, through our gardens. Rewilding the ground behind your house is one of the most direct contributions you can make to the health of the water it drains into. The river now has rights.
